In evaluating your potential case, the first question to be answered is: Did medical malpractice occur under the circumstances of your or your family member's situation? Malpractice occurs when a doctor improperly treats or diagnoses a medical condition, which results in an injury to the patient. Often malpractice is committed by a doctor or hospital through lack of action, such as failing to prescribe a necessary test or by performing an incomplete exam or evaluation. However, there can sometimes be a poor result for the patient without any malpractice having been committed. Although sometimes the malpractice or negligence is obvious, in the majority of cases there are complex medical issues that need to be thoroughly evaluated.
